Understanding Language of Patent Numbers – Part -1 (Germany)

A clear understanding of the format of patent numbers is crucial during search. I have tried to make it very simple here and will try to cover almost all countries in next post. In Germany the application number is retained as the publication number, and finally as the granted patent number. Prior to 1995, the German patent number was generated as a yearly number series with 7 digits in which the first 2 digits represent the application year minus 50. Ex. DE4322577 C2, where the 43 indicates this patent application was filed in 1993. A German utility model number prior to 1995 was generated as a yearly number series having 7 digits, where the first 2 digits represent the year of application. Example: DE7300123 U (application was filed in 1973) From 1995 through 2003, both utility models and patents follow the same number format, an 8-digit number, wherein the first digit indicates the type of document, digits 2-3 indicate the year of application, and the remaining 5 digits are a seria...

Patent Analysis and Reporting – How to make your client Delighted?

Image
Most of the times after receiving the patent analysis report by the vendors, companies or decision makers ask a question: "Very nice, now what I do with it?" It is very essential to avoid these type of questions from the clients in service industry and we have to understand, why does this response happens? Usually, it happens because the analysis involved in the patent analysis and mapping does not really understand the end objective of the client. Thus it is very essential, prior to commencing any search or analysis, the analyst or searcher must clearly understand the objectives and needs of the clients. Nest question comes is How do you know, what the objective is? First, you ask. Then, like a skilled salesperson, you go a level deeper. You ask about the objective behind that stated objective, or perhaps even the objective behind that, until you understand. Sometimes in spite of clear objectives there happen mistakes in the analysis. To avoid this the analyst have to use i...

A Tool For Predicting The Outcome Of Claim Construction in Patent Appeals

Image
The Federal Circuit Predictor tool uses the results of statistical regression analysis of the effect of panel membership on the results (methodological approach: holistic, procedural) of claim construction opinions. This tool accepts as inputs the identity of the three-judge panel hearing a claim construction case at the Federal Circuit. It returns the (statistically) most likely methodological form of claim construction opinion that the panel will issue. Note: Due to the effects of the Federal Circuit's en banc Phillips v. AHW, 415 F.3d 1303 (Fed. Cir. 2005), this tool is no longer a reliable predictor of the Federal Circuit's approach to claim construction. I just wanted to share this tool.
