How to become a Patent Agent in India
A patent Agent is a person who has qualified the Patent Agent (PA) examination conducted by Indian Patent Office (IPO) and is registered and authorized to file patents in India.
Qualification:
The basic qualification is a degree in science, engineering or technology from any university established under law for the time being the force in the territory of India or possesses such other equivalent qualifications as the Central Government may specify in this behalf , and, in addition. There is no obligation that you need to have the experience in Patents, but a sound knowledge and expertise in essential to crack the examination.
Eamination:
The exam consists of two papers. Paper I for 150 minutes tests your knowledge of the provisions in Patent Act, Patent Rules. Some provisions of Trademark Act and IPAB Act may also need to be studiedThe second paper tests your skills in writing Patent Documents. These are advices to clients, preparing formal applications in prescribed forms for filing in the patent office, fees to be paid for them etc. In addition you also have to draft a patent application based on an invention disclosure.
- Paper I – Patent Act and Rules – 100 Marks
- Paper II- Drafting and interpretation of Patent specification and other documents – 100 Marks
- Viva voice - 100 Marks
The qualifying marks for each written paper and for the viva voice examination shall be fifty per cent each, of total marks and a candidate shall be declared to have passed the examination only if he obtains an aggregate of sixty per cent of total marks.The materials for the exam are Patent Act 1970, Manual of Patent Practice and Procedure, drafting license agreement and patent drafting & Interpretation of patent specification. And also go through the previous year’s exam papers.
