A Tool For Predicting The Outcome Of Claim Construction in Patent Appeals

The Federal Circuit Predictor tool uses the results of statistical regression analysis of the effect of panel membership on the results (methodological approach: holistic, procedural) of claim construction opinions. This tool accepts as inputs the identity of the three-judge panel hearing a claim construction case at the Federal Circuit. It returns the (statistically) most likely methodological form of claim construction opinion that the panel will issue. Note: Due to the effects of the Federal Circuit's en banc Phillips v. AHW, 415 F.3d 1303 (Fed. Cir. 2005), this tool is no longer a reliable predictor of the Federal Circuit's approach to claim construction. I just wanted to share this tool.

IBM researchers, including a team from IBM India Research Labs (IBM IRL), have developed a tool — Patent Quality Index — to address the issue of low-quality patents. Using the company’s advanced statistical and data analytics expertise, IBM has created a tool to assist patent applicants, examiners and the public to objectively assess the quality of patent applications and issued patents. Guruduth Banavar, director of IBM India Research Laboratory, told FC that a quantitative or mathematical way of evaluating patent applications was needed. “This tool can compare the user’s report with all existing applications and give an analysis of its quality,” he said.
