Types of Australian Patents
There are two types of patents in Australia: Standard (20 years) and Innovation (8 years).
Innovation patents require a lower level of inventiveness so they’re like the Utility Model of eg Germany and Japan. Examination of an Innovation patent is only compulsory if it is to be enforced. 3rd parties can request examination.
For Standard patents there are two types of examination: Full or Modified. Modified examination can be requested if there is an identical patent already granted in eg US or GB.
The numbering of granted Australian Patents recently changed. Six digit patent numbers are being given to applications filed before 5 July 2002. For applications filed on or after 5 July 2002 the granted patent number is the same as the application number
